Estos términos ("Términos") regulan el acceso y uso de la aplicación Garoé y del sitio https://garoe.app (conjuntamente, el "Servicio") operados por Emanuel Rodríguez Beltrán (Garoé). Al crear una cuenta o utilizar el Servicio aceptas quedar vinculado por estos Términos. Si no estás de acuerdo, no utilices el Servicio.
1. Qué es Garoé
Garoé es una red social deportiva para atletas de CrossFit, HYROX, Running y Gym. Permite registrar entrenos, publicar resultados, seguir a otros atletas, y unirse a Boxes. Funcionalidades y características concretas pueden evolucionar.
2. Elegibilidad y cuentas
- Debes tener al menos 16 años para usar el Servicio.
- Es tu responsabilidad mantener la confidencialidad de las credenciales de acceso.
- Una sola persona física por cuenta. Prohibido crear cuentas automatizadas.
- Nos reservamos el derecho a rechazar, suspender o cerrar una cuenta cuando detectemos fraude, suplantación o violación de estos Términos.
3. Contenido de usuario
Eres responsable del contenido que publiques ("Contenido de Usuario"): entrenos, fotos, vídeos enlazados, textos, reacciones. Mantienes la titularidad de tu Contenido, pero nos concedes una licencia no exclusiva, mundial, gratuita y sublicenciable únicamente para alojar, reproducir, adaptar técnicamente y distribuir ese Contenido dentro del Servicio con el fin de prestártelo. Esta licencia termina cuando eliminas el Contenido o tu cuenta, salvo copias de respaldo que se eliminan en los plazos indicados en la Política de privacidad.
4. Conductas prohibidas
Queda expresamente prohibido publicar o difundir a través de Garoé contenido que, a nuestro criterio razonable, sea objetable, ilegal o perjudicial. En particular:
- Contenido que acose, amenace, difame o incite al odio o violencia.
- Contenido sexualmente explícito, violento o gore.
- Spam, fraude, phishing, estafas, esquemas piramidales.
- Contenido que infrinja derechos de propiedad intelectual o privacidad de terceros.
- Uso del Servicio para promocionar sustancias ilegales o dopaje.
- Ingeniería inversa, scraping automatizado, intentos de eludir medidas de seguridad o acceder a cuentas ajenas.
- Suplantación de identidad de personas u organizaciones.
- Cualquier uso que viole la legislación aplicable.
5. Moderación, reporte y bloqueo
Garoé cuenta con mecanismos efectivos de moderación conforme a las directrices de Apple (App Store Review Guideline 1.2):
- Reporte: cualquier usuario puede reportar un post o un perfil desde la propia app. Revisamos todos los reportes en un plazo máximo de 24 horas.
- Bloqueo: puedes bloquear a cualquier otro atleta desde su perfil; dejará de ver tu contenido y tú el suyo.
- Filtrado: eliminamos o restringimos proactivamente el contenido que infrinja estos Términos.
- Expulsión: los usuarios que publiquen contenido objetable o abusivo serán suspendidos o expulsados definitivamente.
Para reportar comportamientos fuera de la app o abusos graves puedes escribir a support@garoe.app — los revisamos de forma prioritaria.
6. Boxes, coaches y funcionalidades de pago
Algunas funcionalidades se ofrecen mediante suscripción (p. ej. Box Pro). Las suscripciones se gestionan a través del sistema de compras in-app de Apple y están sujetas a los términos de Apple Media Services. La renovación, cancelación y reembolsos se rigen por las políticas de App Store. El precio y condiciones de cada plan se muestran antes de confirmar la compra.
7. Propiedad intelectual
El software, diseño, marca, logotipo, nombre y elementos gráficos del Servicio son propiedad de Emanuel Rodríguez Beltrán o de sus licenciantes. No obtienes ningún derecho sobre ellos más allá del uso personal y limitado del Servicio.
8. Exención de garantías
El Servicio se ofrece "tal cual" y "según disponibilidad", sin garantías de ningún tipo, expresas o implícitas, más allá de las mínimas legalmente irrenunciables. No garantizamos que el Servicio vaya a estar libre de errores o interrupciones, ni que los resultados obtenidos sean exactos.
9. Limitación de responsabilidad
En la máxima medida permitida por la ley, Emanuel Rodríguez Beltrán no será responsable por daños indirectos, lucro cesante, pérdida de datos o perjuicios reputacionales derivados del uso o imposibilidad de uso del Servicio. Nuestra responsabilidad agregada por cualquier reclamación relacionada con el Servicio está limitada al importe que hayas pagado en los 12 meses anteriores o, si no has pagado nada, a 50 €.
10. Indemnidad
Aceptas indemnizar y mantener indemne a Emanuel Rodríguez Beltrán frente a cualquier reclamación de terceros derivada de (i) tu Contenido de Usuario, (ii) tu incumplimiento de estos Términos o (iii) tu infracción de derechos de terceros.
11. Terminación
Puedes dejar de usar el Servicio y eliminar tu cuenta en cualquier momento. Podemos suspender o terminar tu acceso inmediatamente si incumples estos Términos, cometes fraude o generas un riesgo legal o de seguridad. Las cláusulas que, por su naturaleza, deban sobrevivir a la terminación (IP, limitación de responsabilidad, ley aplicable) continuarán vigentes.
12. Cláusula específica de Apple
Estos Términos se celebran únicamente entre tú y Emanuel Rodríguez Beltrán, no con Apple. Apple no es responsable del Servicio ni de su contenido. Apple y sus filiales son, no obstante, terceros beneficiarios de estos Términos y tendrán derecho a hacerlos cumplir frente a ti como usuario final. En caso de fallo del Servicio, podrás notificar a Apple y Apple te reembolsará, si procede, el precio de compra; en la máxima medida permitida por la ley, Apple no tendrá ninguna otra obligación de garantía.
13. Cambios
Podemos actualizar estos Términos. Te notificaremos los cambios relevantes con al menos 15 días de antelación a través de la app o por email. El uso continuado del Servicio tras la entrada en vigor de los cambios implica tu aceptación.
14. Ley aplicable y jurisdicción
Estos Términos se rigen por Legislación española y, en particular, el Reglamento (UE) 2016/679 (RGPD) y la Ley Orgánica 3/2018 (LOPDGDD). Las controversias se someterán a los juzgados y tribunales del domicilio del consumidor en la UE, conforme al Reglamento (CE) 1215/2012.

These Terms govern your access to and use of the Garoé app and the website https://garoe.app (together, the "Service"), operated by Emanuel Rodríguez Beltrán (trading as Garoé). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What Garoé is
Garoé is a social network for CrossFit, HYROX, running and gym athletes. It lets you log workouts, publish results, follow other athletes and join Boxes. Features may evolve.
2. Eligibility and accounts
- You must be at least 16 years old.
- You are responsible for keeping your login credentials confidential.
- One natural person per account. Automated accounts are not allowed.
- We may refuse, suspend or close accounts that engage in fraud, impersonation or breach of these Terms.
3. User content
You are responsible for the content you publish ("User Content"): workouts, photos, linked videos, text, reactions. You keep ownership of your User Content and grant us a non-exclusive, worldwide, royalty-free, sublicensable licence solely to host, reproduce, technically adapt and distribute it within the Service so that we can deliver the Service to you. The licence ends when you delete the content or your account, except for backups deleted within the retention periods described in the Privacy Policy.
4. Prohibited conduct
Posting or distributing objectionable, illegal or harmful content is strictly prohibited. In particular:
- Content that harasses, threatens, defames or incites hatred or violence.
- Sexually explicit, violent or gore content.
- Spam, fraud, phishing, scams, pyramid schemes.
- Content that infringes third-party IP or privacy rights.
- Promotion of illegal substances or doping.
- Reverse engineering, automated scraping, attempts to bypass security or access other accounts.
- Impersonation of people or organisations.
- Any use that violates applicable law.
5. Moderation, reporting and blocking
Garoé provides effective moderation mechanisms in line with Apple App Review Guideline 1.2:
- Reporting: any user can report a post or a profile from within the app. We review all reports within 24 hours.
- Blocking: you can block any athlete from their profile; they will no longer see your content and vice-versa.
- Filtering: we proactively remove or restrict content that breaches these Terms.
- Ejection: users who post objectionable or abusive content are suspended or permanently removed.

6. Boxes, coaches and paid features
Some features are offered on subscription (e.g. Box Pro). Subscriptions are managed through Apple's in-app purchase system and are subject to Apple Media Services terms. Renewal, cancellation and refunds follow App Store policies. Prices and conditions are shown before purchase.
7. Intellectual property
The Service's software, design, brand, logo, name and graphics belong to Emanuel Rodríguez Beltrán or its licensors. You obtain no rights over them beyond limited personal use of the Service.
8. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, beyond those that cannot be waived under mandatory law. We do not warrant the Service will be error-free or uninterrupted, nor that results will be accurate.
9. Limitation of liability
To the maximum extent permitted by law, Emanuel Rodríguez Beltrán shall not be liable for indirect, consequential, lost-profit, lost-data or reputational damages arising from the use or inability to use the Service. Our aggregate liability for any claim related to the Service is capped at the amount you have paid in the previous 12 months or, if you have paid nothing, at EUR 50.
10. Indemnity
You agree to indemnify and hold harmless Emanuel Rodríguez Beltrán from any third-party claim arising out of (i) your User Content, (ii) your breach of these Terms, or (iii) your infringement of third-party rights.
11. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access immediately for breach, fraud or legal/security risk. Provisions that by nature survive termination (IP, limitation of liability, governing law) will remain in force.
12. Apple-specific clause
These Terms are between you and Emanuel Rodríguez Beltrán only, not Apple. Apple is not responsible for the Service or its content. Apple and its subsidiaries are, however, third-party beneficiaries of these Terms and have the right to enforce them against you. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation.
13. Changes
We may update these Terms and will notify material changes at least 15 days before they take effect via the app or email. Continued use after the effective date means acceptance.
14. Governing law
These Terms are governed by Spanish law, in particular Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).Disputes will be heard by the courts of the consumer's domicile within the EU, as per Regulation (EC) 1215/2012.
